These terms apply when you buy a website build or a care plan from Beyond Website Development. Written to be read, not to be survived.
Who you are dealing with
Beyond Website Development is a sole proprietorship operated by Joshua Journet in Kansas, USA. Contact: Joshua.Journet@protonmail.com.
What we provide
Design and development of websites and web applications, and ongoing hosting and maintenance through a monthly care plan. Exactly what is included in your project is set out in the written quote or proposal you approve. That quote takes precedence over any general description on this site.
Payment
- Build fees are one-time. Larger projects may be split into a deposit and a final balance.
- The final balance is due on delivery, before the site is published to your domain.
- Care plans are billed monthly in advance and renew automatically until cancelled.
- All prices are in US dollars. Payment is processed by Stripe.
- If a care plan payment fails, we retry it and contact you. If it stays unpaid for 14 days the site may be suspended until it is settled.
Who owns what
You own your site. Once it is paid for in full, the design, content and code produced for your project are yours, along with your domain and your content. You can take them and go.
We keep ownership of our own reusable components, tooling and techniques, meaning the general building blocks used across many projects. You get a full licence to use them as part of your site; you do not get the right to resell them as a product on their own.
Unless you ask us not to, we may show your finished site as an example of our work.
What we need from you
Projects stall on missing content far more often than on code. You agree to supply text, images, logos and access we need, and to have the right to use whatever you send us. If you send material you do not own the rights to, that is on you, not on us.
If a project goes 60 days without a response from you, we may close it and treat the work completed to that point as delivered.
Hosting and availability
Sites are hosted on Cloudflare's network. We aim for continuous availability but do not guarantee uninterrupted service, and we are not responsible for outages at upstream providers, at your domain registrar, or caused by changes you make yourself.
Liability
To the fullest extent permitted by law, our total liability arising from your project is limited to the amount you have paid us for it in the preceding twelve months. We are not liable for lost profits, lost revenue or lost data.
Nothing in these terms limits liability for fraud, or for anything that cannot lawfully be limited.
Cancelling
See the Cancellation Policy and the Refund & Dispute Policy. Both form part of these terms.
Governing law
These terms are governed by the laws of the State of Kansas, USA.
Changes
We may update these terms. The date at the top changes when we do, and active clients are notified by email. Changes do not apply retroactively to work already agreed and quoted.
